CONCERNING
ADDITION TO POSTPONEMENT CEILING OF PAYMENT OF EXCISE ON ORDER OF EXCISE TAPES OF TOBACCO PRODUCTS

THE DIRECTOR GENERAL OF CUSTOMS AND EXCESE,

Considering:

a. that following the stipulation of regulation of the minister of Finance No. 118/PMK.04/2006 on the second amendment to Regulation of the minister of Finance No. 43/PMK.04/2006 regarding stipulation of cost Price and Tariffs of Tobacco Products, the value of excise yet to be paid by tobacco product manufacturers/ importers increased;
b. that pursuant to the provision in Article 6 of Decree of the Director General of Customs and Excise No. P-08/BC/2006 on Postponement of Payment of Excise on Order of Excise Tapes of Tobacco product, in the case of amendment to Regulation of the Minister of Finance on retail price and/or tariff or excise resulting in an increase in the value of excise yet to be paid, the amount of postponement already given is adjusted as high as the percentage of change in the retail price and/or tariffs of excise;
c. that based on the considerations as described in letters a and b, it is necessary to stipulate a decree of the Director General of customs and Excise on Addition to Postponement ceiling of Payment of Excise on Order of Excise Tapes of Tobacco Products;

In view of:

1. Law No. 10/11995 on Customs (statute book of 1995 No. 75, supplement to statute book No. 1612) as already amended bylaw No. 17/2006 (statute book of 2006 No. 93, supplement to statute book No. 4661);
2. Law No. 11/1995 on Excise (statute book of 1995 No. 76, supplement to statute book No. 3613);
3. Decree of The Minister of finance No. 240/KMK.05/1996 on Settlement of Excise as already amended by decree of the Minister of Finance No. 105/KMK.05/1997;
4. Regulation of The Minister of Finance No. 43/PMK.042005 on Stipulation of cost Price and Tariffs of Excise on Tobacco Products as already amended by the latest regulation of the Minister of Finance No. 118/PMK.04/2006;
5. Regulation OF the Director General of customs and Excise No. P-08/BC/2006 on Postponement of Payment of Excise on Order of Excise Tapes of Tobacco Products;

HAS DECIDED:

DECREE OF THE DIRCTOR GENERAL OF CUSTOMS AND EXCISE ON ADDITION TO POSTPONEMENT CEILING OF PAYMENT OF EXCISE ON ORDER OF EXCISE TAPES OF TOBACCO PRODUCTS

FIRST:

(1) Starting from march 1, 2007, the amount of postponement ceiling already given to tobacco product manufacturers/ importers, which remain effective, shall be supplemented by 7 % (seven percent) of the total postponement ceiling of payment of excise on order of excise tapes of tobacco products already given.

(2) Starting from July 1, 2007, the amount of postponement ceiling already given to tobacco product manufacturers/ importers, with remain effective, shall be supplemented by 5% (five percent) of the total postponement ceiling of payment of excise on order of excise tapes of tobacco products already given.

SECOND:

The addition to the postponement ceiling as described in Dictum FIRST shall not change validity period of decision of granting of postponement already issued.

THIRD:

The decree of the Director General of customs and Excise shall come into force as from the date of stipulation, with the provision that it shall be rectified accordingly in the case of mistakes being found.

1. heads of regional offices of the Directorate General;
2. heads of customs and Excise Service Offices.
